  • • False documents: max HKD 50,000 fine & 6 months imprisonment
  • • IA has authority to impose disciplinary sanctions

Prevention of Bribery Ordinance (POBO)

  • • Rebate can constitute "agent bribery" offense

  • • At least 16 people prosecuted for insurance bribery in 2021

GL25 Gift Guidelines

⚠️ Legal Classification

In Hong Kong, rebate is explicitly classified as "commercial bribery". Insurance companies may treat it as "conspiracy to defraud" between policyholder and agent, thus voiding the policy. This means policyholders not only lose the promised rebate, but may also lose all coverage and paid premiums.

Risks forPolicyholders

Many think accepting rebates is "getting a bargain", not realizing risks far outweigh the rebate amount

⚠风险

Company may treat as conspiracy to defraud

❌

Lose all coverage

Void policy means no claims paid

❌

Cannot recover premiums

Insurer will not refund paid premiums

❌

Industry blacklisted

2 policyholders blacklisted in 2024

❌

Cannot file complaints

Illegal act first, cannot claim legal rights

❌

May be induced to lie

Agent may induce hiding health info, claim denied

❌

Higher reinsurance cost

After void, reinsure at older age = higher premium

❌

Orphan policy risk

Rebating agent may leave or be penalized

💀 Worst Case

You spend HKD 1M on critical illness insurance, agent rebates 100K. Years later you get cancer, need 1M claim. But insurer finds rebate record, voids policy.

Result: You lose 1M coverage, lost 900K premium, that 100K rebate is long spent.
